Illinois Introduces Mobile Identification Cards

Illinois has taken a significant step toward embracing digital identification with the passage of House Bill 4592. This newly enrolled bill, which amends both the Illinois Identification Card Act and the Illinois Vehicle Code, introduces the option for mobile versions of both Illinois Identification Cards and driver’s licenses.

Under the new law, the Secretary of State will issue mobile versions of these identification cards, in addition to traditional physical cards, allowing residents to carry their credentials digitally on their mobile devices. This mobile identification card will be in full compliance with the American Association of Motor Vehicle Administrators (AAMVA) guidelines and the ISO/IEC 18013-5 standard for mobile driver licenses.

The mobile cards will contain all the data elements visible on the traditional physical card, including the holder’s name, photograph, and signature. Mobile identification cards are designed to be accessible via secure applications that users download to their smartphones, providing an extra layer of convenience for Illinois residents.

While the mobile identification card will not replace physical cards, it offers users the option to carry their credentials digitally. However, the law mandates that individuals still maintain physical versions of their ID or driver’s license for situations where the mobile card cannot be used, such as in interactions with law enforcement.

Illinois residents will also have the opportunity to use their mobile driver’s license and identification cards in accordance with the strictest security protocols, ensuring that any data shared is encrypted and limited to the necessary elements for each transaction. The Secretary of State’s office is also tasked with ensuring the privacy and protection of user data, with clear guidelines on how and when information may be accessed by third parties.

In addition to the mobile identification options, HB4592 includes provisions for expedited card issuance, the option for certain individuals, like judicial officers or peace officers, to list work addresses instead of home addresses, and a streamlined process for people released from incarceration or correctional facilities to obtain identification. These changes are expected to improve accessibility and security for Illinois residents, as well as provide a more efficient system for state services.

The bill also mandates that a person may not be required to surrender their mobile device when displaying their mobile identification card to law enforcement, except when necessary for verifying identity. This provision further emphasizes the balance between technological advancement and personal privacy.

Illinois joins a growing list of states that are adopting mobile identification solutions, aiming to simplify identification processes while ensuring that users’ personal information is protected under the law. With the implementation of HB4592, Illinois residents can expect increased flexibility and security when managing their identification credentials.
